General Terms and Conditions for Tredici Performance Center

These General Terms and Conditions ("Terms") govern the services provided by Tredici Performance ("we," "our," or "us") through our performance center. By using our services, including bike fitting, testing, and coaching, you agree to be bound by these Terms. Please read them carefully.

1. Services Provided

Tredici Performance offers the following services:

  • Bike Fitting: Tailored bike fitting services to optimize your riding position and improve comfort, performance, and injury prevention.

  • Testing: Personal performance testing, including but not limited to lactate testing, VO2 max testing, and other effort testing for cyclists and runners.

  • Coaching: Personalized training programs and coaching services for cyclists and runners.

2. Personal Responsibility for Testing and Coaching

By participating in our testing and coaching services, you acknowledge and accept the inherent risks of physical activity, including but not limited to injury, strain, or other health-related issues. You understand that it is your responsibility to consult with a healthcare provider before engaging in any intense or maximal exercise, especially if you have any pre-existing medical conditions or concerns.

Maximal Exercise Testing: Maximal exercise testing (such as VO2 max or lactate threshold testing) is available at Tredici Performance. This testing is conducted at your own responsibility. By opting for maximal exercise testing, you acknowledge and accept the risks associated with such tests, which include the possibility of physical strain, injury, or other health-related issues.

Doctor’s Consent: Prior to undergoing any maximal exercise testing, you must provide a signed doctor’s consent confirming that you are physically fit and cleared for intense exercise testing. If you do not have a signed doctor’s consent you accept taking personal responsibility and are aware of the risks associated with maximal physical testing, when making an appointment at Tredici Performance.

If you do not have a signed doctor’s consent or if you prefer a less intense test, we can offer alternative testing methods that are lower in intensity and do not require maximal exertion.

3. Medical Clearance

If you are participating in testing services that require physical exertion, you are required to:

  • Provide Medical Clearance: If required, provide a doctor’s note or signed consent form indicating that you are medically fit to engage in exercise testing or coaching services. By making an appointment without a signed consent form of the doctor, you consent taking Personal Responsibility, acknowledging that you are aware of the risks associated with physical testing and exercise.

  • Consultation for Health Conditions: If you have any pre-existing medical conditions or concerns, you are advised to consult your healthcare provider before engaging in any testing or training programs.

4. Liability and Risk

  • Personal Responsibility: You agree that you are voluntarily participating in all services provided by Tredici Performance at your own risk. By using our services, you understand and accept the risks associated with exercise and physical testing. You agree to release and hold harmless Tredici Performance, its employees, contractors, and affiliates from any liability for injury or harm resulting from your participation in any service.

  • Limitation of Liability: Tredici Performance shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use of the services provided, including injuries sustained during bike fitting, testing, or coaching sessions.

5. Payments and Fees

  • Pricing: Prices for services (bike fitting, testing, coaching) will be communicated prior to your appointment and are subject to change. Fees must be paid before or at the time of service, unless otherwise agreed upon.

  • Cancellation Policy: You may cancel or reschedule your appointment with at least 24 hours' notice. Cancellations made within 24 hours of the scheduled appointment will incur a fee of 50% of the total service price.

  • Non-Refundable: Payments made for services are non-refundable unless otherwise stated in writing by Tredici Performance.

6. Privacy and Data Protection

Tredici Performance takes your privacy seriously and will only use the personal data collected for the purposes of providing services and fulfilling contractual obligations. We are committed to protecting your data in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy.

  • Data Collection: Personal data, such as your name, contact information, body measurements, health status, and performance results, will be collected and stored in a secure manner for service delivery.

  • Consent: By using our services, you consent to the collection, storage, and processing of your data for the purposes stated in our Privacy Policy.

7. Client Responsibilities

  • Accurate Information: You are responsible for providing accurate and complete information related to your health, fitness level, and any medical conditions or concerns that may affect your ability to participate in our services.

  • Cooperation: You agree to actively cooperate with your coach and Tredici Performance staff to follow training programs, instructions, and advice to ensure your safety and success.

  • Equipment: You are responsible for ensuring that any equipment (e.g., bicycle, clothing) used during our services is in good working condition and suitable for your level of activity.

8. Termination of Services

Tredici Performance reserves the right to terminate services if you fail to comply with these Terms and Conditions, engage in behavior that is disruptive or unsafe, or if we believe it is necessary for the safety and well-being of all parties involved.

9. Force Majeure

Tredici Performance shall not be held liable for failure or delay in providing services due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, or technical difficulties.

10. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of Belgium. Any disputes arising out of or in connection with these Terms shall be resolved through mediation or, if necessary, through the courts of [insert city, Belgium].

11. Acceptance of Terms

By using our services, you confirm that you have read, understood, and agreed to these General Terms and Conditions. If you do not agree with any part of these Terms, you should refrain from using Tredici Performance's services.
